LETHBRIDGE from page 1
Under section 319 of the Criminal Code, "Everyone who, by communicating statements, other than in private conversation, willfully promotes hatred against any identifiable group is guilty of an offence."
Dr. Lethbridge, foimder of the Salmon Arm Cozilition Agednst Racism, said, as far as he knew, the newsletter has not been published since 1994. Though he had files of originals and copies of the newsletter, the police have not asked to see them, he said.
He added that, although it appeared the newsletter had ceased distribution, he believes hate literature in the form of books was being published which warranted investigation.
Judge Owen-Flood ruled in favor of Mrs. Pressler and her husband Claus in their suit against Dr. Lethbridge and Westcom TV Group Ltd. The suit was in response to a controversial Oct. 11, 1993, television broadcast that focused on buildings on the Pressler's property.
The broadcast was shown in Kelowna on CBC-afiiliate CHBC, owned by Westcom. Mr. and Mrs. Pressler were awarded $60,000 and $11,500 respectively in the decision. Dr. Lethbridge is still waiting to hear fiiom his lawyer if there are grounds for an appeal.
The CPA Digest was produced for several years in the early 19903 and Mrs. Pressler's activities were well-known in Salmon Arm, but the CJC had never asked the RCMP to investigate.
"It never appeared that we had sufiSdent irdbrmation on it," said C.JC, Pacific Region, chair Zena Simces. "That is why now, when a judge is saying that this is anti-Semitic and racist material, we feel now that we have a much better case to go, so that's why we've notified the RCMP to investigate.".
Honoraiy legal counsel for the CJC David SUber said that the Lethbridge defamation suit had been going on for several years. During that time "there was a vehicle where this issue was going to be dealt with and we were waiting to see what the outcome was going to be," he said.
"We have called for the RCMP to investigate Mrs. Pressler in view of the serious findings of the trial judge," said Mr. Silber. "Our job is to monitor what is going on and to continue to encourage the law enforcement agencies to discharge their duties." □
