TORONTO — Police wiil probea complaint by a Canadian Jewish Congress delegation that Toronto publisher Errist Zundel broke Canada's Grimirial Code provisions against hate when he celebrated his court victory.
Bernie Farber, CJC's act-irig national community relations director, said last week that the delegation has given police recordings of statements Zundel madeata news conference after a Supreme Courts of Canada, by a 4-3 margin, struck down "his • "conviction for
spreading false news about the Holocaust.
During television and radio interviews, Zundel denied the existence of the Holocaust^ Canadian Press quoted the CJC delegation as saying. Zundel called Holocaust Siirvivors liars and said the Holocaust was a hoax engendered by Jews to raise money, the CJC added.
Section 319 of the Criminal Code of Canada bansthe wilful promotion of hatred against an identifiable group.
The Supreme Court's decision two: weeks ago rejected a separate section of the Criminal Code, the "false news" law, as unconstitutional. The law serves "no objective of pressing and substantial cbncern," Madame Justice BeverIy McLachlin wrote iir the majority opinion.
McLachlin called Zuri-del's work "admittedly offensive," but wrote: "To permit the imprisonment of . people, or even the threat of imprisonment, on the ground that they have made a statement which 12 of their co-citizens deem to be false and riiischievous to some undefined public interest, is to stifle a whole range of speech;"
Iri an 83-page minority opinion written jointly by Judges Peter Cory and Frank lacobucci, the three dissenting judges wrote that Parliament's objective of preventingsocial harm justifies limits on free speech.
Last month's Supreme Court ruling "in ho way exonerates the perpetrator," the CJC said in Ottawa. .
"The Supreme Court ruling," said David Sat ok, community relations committee chair for the CJC's Ontario Region, "in no way changes the finding by two separate juries that Ernst ZurideJ, in purveying Holo-.. caust denial, was guilty of deliberately prbpagiating falsehoods which were injurious to the public interest." ;
"The seven years of bat-tiing Zundei in the courts was fully worth it," added Ontario Region chair Gerda Frieberg, a Holocaust.Survivor. "As a result, Zundel has become a synonym for despicable, malicious false-hood and group libel." . Satok added that if Zuri-: del is "obstinate and reckless enough" to resume Holocaust denial activities in
Canada, "we would hope that the authorities should not hesitate to invoke the anti-hate law, which the Supreme Court has already upheld as valid, against him as quickly as possible."
In Toronto, the League for Human Rights of B'nai B'rith Canada urged Ontario attorney-general How-ard Hampton to lay hate propaganda charges against Zundel.
While we regret the Supreme Court's decision to strike down the *false news' law, we feel that another effective remedy for Zunr del's hatemohgeririg is already on the books," said Marvin Kurz, the league's Ontario regional chairman.
"What is needed now is for the government of Ontario to show its commitment to eradicating bigotry by charging Zundel for inciting
hatred against Jews," added Kurz, who argued B'nai B'rith's intervention before the Supreme Court.
"This ruling in no way vindicates Zundel's hateful activities. It merely deals' with fine points of law," said Stephen Scheinberg, the league's national chairman. "It is in the interest of all Canadians to see.that Zundel is convicted for disseminating hatred."
