The opposition to the use of analgesics during parturition did not commence only with the application of chloroform by Sir James Young Simpson a little over a century ago. Nor did the agitation cease with the acceptance of the new drug by Queen Victoria at the birth of Prince Leopold in 1868. The New York Report of the Joint Commission on Christian Healing of 1926 informs us that "before the discovery of anesthesia, a woman in France waa detected in an attempt to ease the pain of childbirth with the help of another woman. This was construed as a blasphemous attempt to thwart the curse laid upon Eve, and both women were burnt to death." Towards the end of the last century a moralist of the
before death � whether natural or by execution � because "they deprive a man of the capacity to act meritoriously at a time when the competency is most necessary." Severe pain, in the Jewish view, can paralyze the mind no less than morphia, even if its effects may be less visible. The meticulous Jewish regard for shortening and mitigating the agony of capital convicts shows, moreover, that the infliction of pain is not an essential part of their punishment and does not constitute a condition for the atonement of their crime.
Finally, we may briefly consider a rabbinic argument on human pain which sheds an interesting light on an important aspect of our subject. While the masters of Jewish law generally agreed that the infliction of cruelty on animals constitutes a biblical offense, they were in dispute on whether this law could technically be invoked against causing pain to humans, too. Some rabbis could see no reason for discriminating between man and beast in this respect. But others held the opposite view. They reason that "the Tor ah is concerned only about pain caused to brutes, because
they lack knowledge and the intelligence to endure suffering, whereas man can choose to ease his mind and to accept with love whatever befalls him." This contrasts toto caelo with the Christian argument that animals cannot be entitled to strict rights since they are not possessed of reason and personality.
There is also a talmudic parallel for the opinion that, in some respects, greater legal protection is extended to the animal than to man. The law, "Thou shalt not muzzle the ox when he treadeth on the corn, carries the biblical penalty of flagellation only in regard to animals, but not for the imposition of similar restraints on human workers. This discrimination, too, it has been suggested, is due to the fact that "a human worker is different, because he is gifted with intelligence. Similarly, a slave enjoys more legal security against exploitation or degradation than a hireling or '?ee worker. In __other words, therefore, Jewish law relates its protective legislation to the need for it: the more defenceless a -creature, the grcater^ts claim-to-sympathy and considerate treatment.
