When a Canadian Human Rights Commission Tribunal holds hearings, starting May 25, on the case of Canadian Liberty Net, it will face the daunting task of deciding how far free speech can go on the telephone before it becomes a hate message, which is contrary to Section 13 of the Human i Rights Code.
Irvine E., Epstein, Queen's counse 1, the promineiit Vancouver lawyer and former chairman of Canadian Jewish Congress (Pacific Region) will represent two of the complainants: Dr. Michael Elterman. former chairman of the CJC (Pacific Region) and Aziz Khaki, chairman of the Committee for Racial Jus-. tice.
Epstein admits that his submission at ^ the hearing : will be a real balancing act between freedom of speech and a person's civil rights-He said he's hopeful the Tribunal will be able to set the parameters of free speech which are acceptable in a democratic country like Canada.

"A truly free and democratic society exacts the guaranty of rights andfreedoms which really 'bite,' which guarantee the exercise of those rights and freedoms when one really needs that guaranty, as the respondents say they do, now."
But, the judge goes on.
"They probably do not need and have surely transcended the same 'freedoins' of speech arid expression which are accorded only by the totalitarian states."
Further, says Muldopn, the respondents'argument is powerful in the right circumstances. But, he asks, would the imposition of an interlocutory injunction in these circurhstances be ah unwarranted interference with their rights an^ freedoms?
"When one penetrates the bodyguard of semantics," he says, "what essentially are their rights and freedoms? Is one of the world's most humane declarations of human rights and freedoms a vehicle for legitimating the disparagement and ridicule of human beings for no just cause? Such, the court finds those messages, or most of them to be."
Muldoon says, "It is not an easy choice to make between freedom of expression arid speech on one hand, and its temporary, suppression in the name of sparing people and "the

The Federal Coiirt. in its decision, said it had the authority only to issue an i n te irlbc u to r y (t e m p or a r y) inju net ion but tha t the CHRC Tribunal could determine if the ban of the phone service could be permanent or otherwise.
In his decision, Federal Court judge Francis Muldoon said the CHRC has been given by Parliament "a wide array of considerable power and discretionary authority .: . and in its own right is truly the guardian of the federal hum^n rights legislation."
The judge added that it will be the task of the Tribu-naltpdetermine whether the respondents'(Canadian Liberty Net) messages are truly likeily to expose persons to hatred or contempt:
If those messages do actually constitute disparagement and ridicule of the "target humans," the court "holds that they are capable of doing the mischief Ayhich the Canadian Human Rights Act is femplaced to combat."
Dealing with the free speech arguments of Canadian Liberty Net, Judge; Muldoon said: "The respoh-dents' strongest argument goes like this — There is no freedom of speech and. expression unless one be tree to give offence, since freedom to speak and give no offence permeates even the
injury of verbal disparagement just for being what they are.
"The court, in its discretion, concludes that the expression of the disparaging words can wait or be stilled pending the deliberations of the Tribunal."
in reviewing some of the phone messages, the judge described them as "fatuous and shallow," quite apart from their racial and religious disparagement of all of humanity except for the "pure-euro" races.

The judge ridiculed this "so-called kosher tax," and said any protest against it could beexpressed in a legitimate free-speech manner by telling consumers that "the cost oughtjustly to be borne by those who cause it to be imposed . . . Freedom of jhought, opinion and expresr sion surely allow for and protect that communication and it ridicules no one."
Judge Muldbon went on:. "The respondents may be surprised to learn that it is not only the; Jews who seek kosher food, if not soaps also. They are referred to the Koran, Surah V, verses 3 and 5."
The case will beargued on beha 1 f of the C H RC by J ohn L. Fin lay, of the firm of Arvay, Finlay of Victoria. Canadian Liberty Net will be represented by Doug. Christie, also of Victoria.
