He states, "Consequently the Dominion act applies here, if the relationship between the owners and the fishermen is that of employers and employees; but it does not apply if that is not the relationship which subsists."
Robertson, too, deals with both assumptions whether the fishermen were or were not employees and finds the union liable both under statutory law (Trade Unions Act) and common law. Share fishermen are not employees of the owners, in his opinion.
ISSUES STILL UNCLEAR
As a result, the questions of the relationship of share fishermen to owners and the legislative authority to regulate labor relations involving fishermen remain as unclear as they were before the appeal.
The decision poses the question: how are union officers, fishermen, Labor Relations Board members and legal advisers to determine the points at issue to assure the legitimacy of bargaining relations and strikes when the judges in the province's highest court cannot agree?
Absolute clarity can only be obtained, it seems, from the Supreme Court of Canada if the union decides to pursue its appeal.
The certainty is that enlightened labor legislation at the appropriate level to include all classes of fishermen and formalize bargaining rights exercised for more than 80 years, must be implemented if fishermen and their union are to escape costly litigation in the future.
The appeal court also dismissed a cross appeal launched by counsel for the vessel owners. The owners appealed for exemplary and aggravated damages which would have increased the total award for damages.
Mr. Justice MacLean decided that the $108,000 judgement was intended in part as punishment, a position adopted by Chief Justice Davey and Mr. Justice Robertson.
Alaska salmon prospect poor
Moderate or poor returns to most river systems are expected to produce below average catches during the 1972 Alaska salmon season.
Alaska fish and game department predicts that pink salmon runs in the southeast Alaska and Kodiak Island areas will contribute heavily to a total harvest of about 47 million fish, about 13 million fewer than the even year average during the sixties.
Southeast Alaska should produce about 16.5 million pinks and Kodiak about 6.5 million. A Bristol Bay red salmon harvest of 5.1 million is forecast.
