Although the union said it had expected legislation to step up energy exports, it was nonetheless surprised at such totally regressive procedures.
"We never dreamed the government would be so bold as to bring such an anti-democratic, unpopular piece of legislation. Moreover, we never dreamed the government would have the gall to attempt to push such an important piece of legislation through in the space of two weeks."
The bill received first reading Aug. 8.
Following ministerial approval, projects will be subject to a so-called energy review process, except for those projects which were under way before the proclamation of the act. Projects covered include:
• electric generation plants, hydro and thermal, with a capacity of 20 megawatts or more;
• energy use projects which use, convert or process significant amounts of total energy resources and coal;
• large transmission pipelines for liquid or gaseous hydrocarbons or solids;
• any undertaking deemed by the cabinet to be sigificant enough to warrant review.
In summary, section 19(a) and (c) allows both ministers to approve energy projects without public hearings:
"With the concurrence of the minister of the environment, the energy minister may order that the construction and operation of the regulated project is exempt from provisions of this act specified in the order."
Section 20 (3) allows the commission to exclude the public from an hearing if it considers that any submitted evidence is of confidential nature.
Section 21 (2) states all commission decisions are irrevocable and places Bill 52 beyond the jurisdiction of the Pollution Control Act and the Water Act.
In applications requesting the removal of resources for export purposes Section 22 (a) and (b) include so many exemptions that licences may only rarely be required.
Finally, Section 24 (1) allows the minister to issue an energy removal licence with no chance of a public scrutiny of the proposal:
"On receipt of an application under Section 23 the minister may refer the application to the commission for a review or issue an energy removal certificate to the applicant."

The dredge and its tender occupy a 600-foot stretch in the centre of the Fraser stream. Both upstream and downstream, two buoys provide further obstacles to fishing. UFAWU demands to have the buoys removed have resulted in a transport ministry meeting on the subject in September.
UFAWU organizer Dennis Brown, who contacted the harbor commission to protest the dredge approval, said commission head Chris Brown was completely unsympathetic to the fishermen's problem.
"He takes the view that everyone must get along," the union representative said, "and worries that the dredging company will lose a lot of money. The company says it's prepared to co-operate with fishermen, but the commission just doesn't take the time to consult before it issues the permit.
"Now they claim they don't know when the openings will be and can't take action to avoid them."
"The commission is playing with the lives of fishermen," union business agent Bill Pro-copation said. "Instead of cooperation, they simply post a notice.
"They dredge and work day and night all year, but when the fishery is open, thev should lay off." _"
