Hate propaganda, rather than simple smuggling charges, should be brought against three Quebec men re-. cently apprehended by the RCMP for not declaring Ku Kiux Klan publications at the border! say B'nai Brith and Canadian Jewish Congress.
The three were caught in the woods Nov; 19 with 1,250 copies of The Klansman close to the international border near Stanhope, Que. The Klansman has been declared hate literature by both Canada Customs and Quebec Justice Minister Gil Remillard.
The trio were charged by the RCMP this month with smuggling the publications into Canada from the United States, after failing to declare the material at the border. The decision whether to add the charge of spreading hate rests in the hands of the Crown.

CJC Quebec Region chairman Gbl-die Hershon said: "We would strongly encourage the responsible authorities to bear in mind during the proceedings against these three in-
dividuals that the materials they are accused of having brought into Canada Nov. 19 constitute, in our opinion, hate literature as per Article 319 of the Canadian Criminal Code.
"It is essential that those accused of perpetrating this kind of intolerance within our society be prosecuted to the full extent of the law."
BB government relations director Ian Kagedan pointed to the example of Manitoba where KKK members were prosecuted as hate mongers. BB has charged Quebec judicial officials with attaching "an inadequate level of priority" to KKK activity in the province and alack of co-ordination among the various police forces and the Sherbrooke Crown prosecutor's office.
Still pending is Sherbrooke Crown prosecutor Michel Pinard's decision on-a Surete du Quebec report on KKK activity in the Eastern Townships.
Last July, persons dressed in white KKK robes and hoods distributed The Klansman in a couple of Townships villages on the street. In the spring, an earlier issue of The Ktansman was found in the mail boxes of homes in the Townships.

Winnipeg police are busting the Klan in Manitoba.
Following a lengthy undercover investigation, the police have charged William James Harcus, 21, and Theron Maurice Skyba. 25. on Dec. 19 with advocating and promoting genocide under Sec. 318 of the Criminal Code under the Hate Propaganda heading. This may be the first time this charge has been laid in Canada since the law was adopted following a human rights convention held just after \ World War II.
^ Police have also charged Skyba and Joseph Edward Lockhart, 27, with mischief after a telephone message dealing with homophobia was tampered with and changed to a message attacking gay people. Other charges against other alleged Klan members may follow, reports Crime Inspector Con Gislaspn.
Human rights and multicultural groups and opposition politicians have been clamoring for action against the Klan for over a year since the first "business cards" and Klan literature were distributed around Winnipeg and other Manitoba communities. Harcus was identified as a Klan leader as early as last February when he gave an interview to a local television station.
Gislason describes the police effort as a deliberate and dangerous investigation. He reports that up to 20 officers were in-
volved. According to their findings, there were about 20 people involved in Klan activities comprising two groups in Winnipeg and one in Gimli, about 100 kilometres (60 miles) north of Winnipeg.
"In a society such as ours, there will always be fringe people attracted to the Klan philosophy," Gislason says. "There has been Klan activity here in the past but no evidence of a continued growth such as you might find in Alberta. In the last couple of years there has been a resurgence. We responded to that resurgence. Our investigations showed the Klan was well connected to other Klan organizations in the United States and elsewhere in Canada."
In making the arrests, police raided six Winnipeg homes and seized a large quantity of material. They also seized some weapons owned by Skyba. A KKK hotline spewing out racist messages was also disconnected. The hotline had been operating openly for several months.
"We are obviously pleased the police investigation is concluded and charges have been laid," says Murray Trachten-berg, chairman of the B'nai Brith League for Human Rights Midwest region. "We are continuing though with our complaint about the KKK hotline to the Human Rights Commiission. We are concerned that although the phone line has been disconnected, it could be reopened again one day. As well, this action doesn't prevent other racist groups from installing Other such hotlines."
