The Public Prosecutor's office in Frankftirt-am-Main 4s preparing for tiie trial of 28 members of the $.S. who served in the extermination camp at Auschwitz.
Ainbng the accused will be the last commandant of Auschwitz, Richard Baer; Dr. Viktor Capesiiis, accused of haying been in charge of the camp's supplies of poison gas, "Cyclone B"; Josef Kiehr, the leader of the "disinfection squadi" the euphemistic term for those S.S. men who had the task of supplying the gas chambers with poisonous gas; the acting leader of the " Political Department", the; .cailip Gestapo who were responsible for indescribable tortures; and many «c-S.S. men, doctors and dentists.
During recent months a number of former S.S. men for whom warrants were outstanding have
been traced. Others, however, are still being sought, among them the erstwhile Auschwitz camp doctor. Dr. Josef Mengele, who fled the Argentine after the local authorities had at last got roimd to dealing with a German extradition demand.
A notorious war criminal whose whereabouts are known but who cannot be taken into custody is Dr. Horst Schumann, formerly of the Germein Air Force. At his own re-q^uest, he conducted sterilisation experiments in Auschwitz. Today he lives in Ghana and boasts openly of his friendship with President Nkrumzdi. Ghana refuses to extradite him.
Preliminary investigations haye also been ope- ' ned ag£unst the Auschwitz administrative chief, S.S. Major Burger, and it is possible that the number of accused in this long-
delajred trial will increat^ se still further.
All the indictment material has been collected and sifted, over UOO witnesses examined and a survey made of all the crimes committed in Auschwitz,
Hundreds of Auschwitz survivors from many countries have been heard, and the files in the case take up over 70 volumes. Even the largest courtroom in Frankfort would be too small for the hearing of such a case, which is expected to last several months and will no doubt be carefully watched by the international press. This one great trial is intended to make a clean legal sweep of all crimes committed in Auschwitz.
As a result of the pror ceedings a great task will also be faced by the Austrian courts. Investigations have been conducted into the activities of all

The news from Israel hinted
that the Chief Rabbhiate there had refused to allow R&bU Myron Fenster, of the Morlah Synagogue In Haifa, to perform a marriage ceremony, and that it had not recognised the "semi-cha" (ordination) granted tb him by the Jewish Theological Seminar of America (Conservative).
In an interview wltH the JCNS correspondent here, iRabbi Rel-man said: "Rabbi Fenstef^ has not been turned down; he was merely asked to take a test regarding his rabbinical qualifications, and I have every confidence that he would have passed the test". He said that the Rabbinical Assembly had been
prepared to pursue the matter to a conclusion if necessary, but that it had become "aCTdemic to view of the fact tha: '.abbs Fenster, who had agreed to serve the congregation for only one year, is returning soon to the United States".
Rabbi Kelman added that Con servatlve "gittln'' (divorces) had been accepted and were being accepted in Israel, and that a
number of divorces had been approved the past three months. He also announced that the successor to Rabbi Fenster will be Rabbi Ephraim -Frank Man-
delkom, a native of Montreal and a graduate of the class of 1944 of the Jewish Theological Seminary.
Rabbi Mendelkom completed his u ndergraduate work at Yeshlva Utilversity, which is imder Orthodox auspices, and there won the Talmud Prize. He is considered an outstanding Talmudist Rabbi Kelman said. He served as a chaplain in the Canadian Army during the last war.

mclude S.S. officers who had increased responsibilities in Auschwitz, like the camp doctor. Dr. Georg Franz Mwer, bom in Vienna in 1917 and stil resident there, practising medicine without let or hindrance. .
To appreciate the functions of the S.S. medica men in Auschwitz one should recall what the First comniandant. of the camp, S.S. Obersturm bannfuhrer Rudolf Hoss, said at the time:
"In addition to then: normal medical tasks the S,S. doctors in Auschwitz discharged the following duties; On arrival of tran sports of Jews they had to select male Jews fit for work and Jewesses accorduig to the principles laid down by the Reich Medical Officer of the S.S. They had to attend the actual process of extermination in the gas chambers in order to supervise the prescribed use of Cyclone B gas by the disinfection sauaa. After the--opemhg_OT the chambers they had to sF tisfy themselves that tiie extermination was -com plete.
"In Auschwitz, Birkenau and the labour camps they had the nmning job of removing and handing over the extermination, the Jews who had become unfit for work and would not presumably be restored to fitness within foiu" weeks. Cases confi' ned to bed had to be killed by injection, the others to be killed by poison gas in the_crema-. toria."
The erection of gas chambers and crematoria was the most urgent and" extensive activity of the central construction office of the Wagen-S.S. Two sub-leaders of this department, Walter Dejaco and Hermann Togerl, are among those involved in the investigations in Austria. Dajeco is today a builder in Reutte m the Tyrol. Tofferl in Linz.
Another Austrian S.S. leader at Auschwitz, Johann Schindler, lives in Amstetten. where he owns an autfitter's shop. This man had an vmusual career at Auschwitz. He arrived there in 1940 as a modest corporal (Unter-scharfuhrer): by 194344 he had become the adjutant of the commandiuat of Birkenau (the most extensive camp within
the Auschwitz complex, where four crematoria were working full blast day and,night).
Nearly five years have passed since mformation was fu-st laid by survivors of the Auschwitz death camp. In Frankforte two PubUc Prosecutors have )een busy for almost three years with nothing jut the prieparations for the Auschwitz -.trial. In Austria, too, the first denunciation by Auschwitz survivors reached the authorities three years ago.
The organs of the judicial system in Germany and Austria are not free from blame for having contributed to this long delay. The names of the jrincipal criminals have ong • been known, the evidence available, at the very latest, since the Nuremberg Trials. No satis-actoi^ explanation has itx been forthcoming as to why the Public Prosecutors have been waiting or denunciations from the ranks of the survivors.
