By FRED GOLDSTEIN, J.C.N.S. Correspondent in Paris
A French-Algerian lawyer, wj;ib claims to have been retained for the defence of an Arab terrorist captured in Israel, has threatened that "if the Israeli authorities break their word and deny me the right to defend my Palestinian client, the trial will take place anyway —outside Israel—and there are a thousand ways of harming that country."
The lawyer is Maitre Jacques Verges, a specialist in the defence of F.L.N, members during the Algerian war and later editor in Paris of the pro-Chinese journal "Revolution Afri-caine." A convert to Islam and an Algerian by naturalisation, he married Djamiia Boupacha, a "herione" of the Algerian revolution.
His client is Mahmud Hedjazi, a member of the El Fatah terrorist organisation who was captured .near \ Lachish during a pitched battle with Israeli soldiers, I and sentenced to death bv | an Israeli military court in June. The Israeli Supremo Court quashed the sentence, ruling that Hedjazi was entitled to choose his own laW'Ver from any countr\'.
FROM JORDAN
The Israelis expected that an Arab lawyer from a neighbouring country would appear lor Hedjazi bui. when there was no response. Me. Verges suddenly appeared on the scene, crossing the Mandelbaum Gate from Jordan with a French passport, and claiming to have been retained by members of the Hedjazi family in Algeria.
In Israel, .Me. Verges was allowed to see Hedjazi in prison and got his approval to defend him. During his stay in Israel, the lawyer went out of his way to make anti-Israeli statements, approving the then recent e.xecution by the Syrians of Eli Cohen, accusing Israel of practising racial discrimination and repeatedly speaking of "Palestine" rather than Israel.
'This was i ndirect contravention of an unofficial, tacit agreement that he would be allowed to enter Israel and defend Hedjazi
on condition that he did not make a pohtical issue out of the trial.
His statements in Israel alerted both the authorities and public opinion, and this week the Bar Council recommended that permission should not be given to Me. Verges to re-enter Israel for the hearing.
Exploiting Israel's doubts, the lawyer has initiated a publicity offensive, publishing in the moderate Tunisian weekly, "Jeune Afrique" an open letter to the Israeli Minister of Justice, claiming that Eichman was treat-ed better than Hedjazi.
Ms. Verges's office in Paris is located in a narrow.
picturesque street in the Latin Quarter on the Left bank of the Seine. Three flights of stairs in an old building took me to the suite of "New International Editions," directed by Me. Verges,
AFRICAN BRIEFED
In conversation with your correspondent, Verges reiterated his threat to "hold the trial" outside Israel if he were not permitted into the Jewish State. "Together ^vith my African and Asian colleagues, I shall save Hed-jazi's life," he said claiming that he had already briefed M. Demba Diallo, a leading lawyer from Mali and a former member of the Mali
Cabinet. A Senegalese law-, yer of "similar calibre" would also be briefed, he said. V
"I had sent a cable," declared Me. Verges, "to the IsraeU Bar Association, asking then to give me a hearing before they advised their Justice Minister on whether or not I should be allowed to represent Hedjazi.
"But if the -Israeli authorities break their word and prevent me from going. I still have a thousand means of harming Israel outside her frontiers and of saving the Palestinian patriot... I shajl kick up a first-class scandal in all Africa."
